TERMS OF SERVICE

TERMS OF SERVICE

Last updated: 25 October 2026

Welcome to PERENE.

These Terms of Service govern your use of our website and the purchase of products and services from PERENE.

By accessing our website, placing an order or engaging our custom apparel services, you agree to these terms.

Throughout these Terms, "PERENE", "we", "us" and "our" refer to the business operating this website.

Nothing in these Terms excludes, restricts or modifies any rights or remedies available under the Australian Consumer Law or other applicable laws.

1. General Conditions

PERENE provides performance apparel, custom sportswear, teamwear, event merchandise and related products.

We reserve the right to refuse or cancel orders where reasonably necessary, including in cases of suspected fraud, product unavailability, incorrect pricing or unlawful activity.

If we cancel an order after payment has been received, we will provide an appropriate refund.

Customers are responsible for providing accurate information when placing orders or submitting enquiries.

2. Products and Pricing

All prices displayed on our Australian website are in Australian Dollars (AUD) and include GST where applicable, unless otherwise stated.

We make reasonable efforts to ensure product descriptions, images, specifications and pricing are accurate.

However, product colours may appear differently depending on screen settings, lighting and manufacturing processes.

We reserve the right to update product prices, specifications and availability without prior notice. Changes will not affect orders already accepted unless otherwise agreed.

3. Orders and Payments

Orders are subject to product availability and payment confirmation.

Payment must be completed in accordance with the payment terms provided at checkout or specified in an approved custom order quotation.

For custom apparel, teamwear and event merchandise, separate payment arrangements may apply and will be confirmed before production begins.

An order confirmation acknowledges receipt of an order but does not necessarily constitute acceptance where an obvious error or other legitimate issue requires resolution.

4. Custom Apparel and Merchandise

PERENE offers personalised products, including custom triathlon apparel, cycling kits, running apparel, teamwear, club clothing and event merchandise.

Custom orders may involve additional requirements relating to design, sizing, quantities, production and delivery.

Design Approval

Customers are responsible for reviewing and approving final artwork, including:

  • Colours and design layout.

  • Logos, names, numbers and spelling.

  • Product specifications and garment styles.

  • Sizing and quantities.

  • Placement of artwork and branding.

Once final artwork has been approved and production has commenced, changes may not be possible.

Any requested changes after production has commenced may incur additional costs and delays, subject to feasibility and agreement.

Customer-Supplied Artwork

Customers confirm that they own, or have permission to use, all logos, images, trademarks and artwork supplied to PERENE.

PERENE may decline to reproduce artwork where there are reasonable concerns regarding intellectual property rights or unlawful content.

Manufacturing Variations

Custom apparel is manufactured using specialised fabrics, printing techniques and production processes.

Minor variations in colour, positioning, measurements and fabric appearance may occur within reasonable manufacturing tolerances.

Such variations do not automatically constitute a defect. This does not affect customers' rights where products fail to meet applicable consumer guarantees or agreed specifications.

5. Custom Order Production Timeframes

Production timeframes vary depending on product type, order quantity, design requirements and manufacturing schedules.

Estimated production times will be communicated during the quotation or ordering process.

Unless expressly stated otherwise, production timeframes refer to manufacturing and do not include shipping or delivery.

For example, an estimated eight-week production period does not necessarily mean the order will be delivered within eight weeks.

Additional time may be required for international freight, customs clearance, domestic delivery and unforeseen logistics delays.

PERENE will make reasonable efforts to meet communicated timeframes and advise customers of significant changes.

Where a specific delivery deadline is essential, customers should notify PERENE before confirming their order.

Any rights or remedies available under Australian Consumer Law for unreasonable delays or failure to supply remain unaffected.

6. Sizing and Fit

Customers are responsible for selecting garment sizes using the sizing guides and product information provided.

Custom apparel may use different sizing specifications from standard retail clothing.

We recommend reviewing the relevant size chart before ordering.

Where available, customers may request additional sizing assistance before placing an order.

Incorrect size selection or personal fit preference does not ordinarily qualify for a change-of-mind return on made-to-order products.

However, where a garment is incorrectly manufactured, incorrectly supplied or otherwise fails to meet applicable consumer guarantees, customers retain their legal rights.

7. Shipping and Delivery

PERENE offers domestic and international shipping on eligible products.

Shipping costs and estimated delivery times are outlined in our Shipping Policy or provided in individual custom order quotations.

Delivery timeframes are estimates unless expressly agreed otherwise.

Customers are responsible for providing accurate delivery information.

International orders may be subject to customs duties, import taxes and other charges, depending on the destination and agreed shipping terms.

PERENE will communicate known shipping arrangements and charges where applicable.

For additional information, please refer to our Shipping Policy.

8. Returns, Refunds and Exchanges

Returns and refunds are managed in accordance with our Returns and Refunds Policy and applicable Australian Consumer Law.

Standard Retail Products

Eligibility for change-of-mind returns or exchanges is determined by our published Returns and Refunds Policy.

Custom and Made-to-Order Products

Because custom products are manufactured specifically for the customer, we do not ordinarily accept change-of-mind returns or cancellations once production has commenced.

This includes changes of preference relating to approved designs, quantities or correctly manufactured sizes.

Cancellation requests received before production begins will be assessed individually, taking into account any design work, materials or other costs already incurred and the terms agreed with the customer.

Faulty or Incorrect Products

If a product is faulty, incorrectly supplied, not as described or otherwise fails to meet applicable consumer guarantees, customers may be entitled to a repair, replacement, refund or other remedy under Australian Consumer Law.

Nothing in this policy limits those rights.

9. Club, Team and Group Orders

PERENE may offer custom ordering arrangements for sporting clubs, teams, organisations and events.

These may include individual orders, bulk purchases or private online ordering stores.

The nominated club or team representative is responsible for communicating relevant information to participants where they coordinate orders.

Where customers order individually through a private store, each customer is responsible for reviewing their selected products, sizes and personalisation details.

Order deadlines, minimum quantities, payment requirements and production schedules will be communicated before orders are finalised.

Additional terms may apply to particular club or event arrangements and will be disclosed before acceptance.

10. Intellectual Property

All original PERENE branding, website content, graphics, photographs, product descriptions and designs remain the intellectual property of PERENE or their respective rights holders.

These materials may not be reproduced, distributed or used commercially without appropriate permission.

Customer-supplied logos and artwork remain the property of their respective owners.

Ownership and permitted use of custom designs created for customers will be governed by any specific design agreement or written arrangement.

11. Website Use

Customers agree not to use our website for unlawful, fraudulent or harmful activities.

Users must not attempt to interfere with website security, access restricted systems without authorisation or misuse website content.

We reserve the right to restrict access where reasonably necessary to protect our business, customers or website.

12. Third-Party Services

Our website operates using Shopify and may integrate third-party payment, shipping, marketing and other services.

These providers may have their own terms and privacy policies.

PERENE is not responsible for independent third-party websites or services outside our reasonable control, except where liability cannot lawfully be excluded.

13. Privacy

We respect customer privacy and handle personal information in accordance with our Privacy Policy and applicable privacy laws.

By using our website or services, customers acknowledge that personal information may be collected and processed for legitimate business purposes, including order fulfilment and customer communication.

Please refer to our Privacy Policy for further information.

14. Limitation of Liability

To the extent permitted by law, PERENE is not responsible for losses arising from circumstances beyond our reasonable control.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including obligations under Australian Consumer Law.

15. Changes to These Terms

PERENE may update these Terms of Service periodically to reflect changes in our operations, products or legal requirements.

The current version will be published on our website.

Changes will not retrospectively alter agreed order terms without a lawful basis or the customer's agreement.

16. Governing Law

These Terms are governed by the laws of Western Australia and applicable Commonwealth laws of Australia.

Nothing in this section limits any mandatory legal protections available to customers.
